The Yardage App

Legal

Terms of use

Written to be read in one sitting. The short version: the number is an estimate to the center of the green, Apple handles the money, and you play at your own risk.

Updated

Effective . These terms are a contract between you and Give Yourself Three LLC (“Yardage”, “we”, “us”) for the Yardage app and this website. They are written to be read, not skimmed. If you don’t agree with them, don’t use the app or the site.

1. What these terms cover

They cover two things: the Yardage app for iPhone, in its public App Store version and in any TestFlight beta version you install, and the website at theyardageapp.com, including the guides, the tools, the course directory, the Golf Course Census and the forms. Together, the “Service”.

Your download and use of the app is also governed by Apple. The App Store version is licensed to you under Apple’s standard Licensed Application End User License Agreement; beta versions are also subject to Apple’s TestFlight terms. Where those Apple terms and these terms say different things about the app, Apple’s terms control for the matters they cover. Apple is not a party to these terms and is not responsible for the app or its content, but Apple and its subsidiaries may enforce these terms against you as third-party beneficiaries.

Our privacy policy explains what data the app and the website handle. It is part of these terms.

2. Who can use the Service

You must be able to form a binding contract where you live, and you must not be barred from using the Service under any applicable law. The Service is not directed to children under 13, and we don’t knowingly collect personal information from them. If you use the Service on behalf of a golf course or another organization, you confirm you’re allowed to bind it to these terms.

3. What the app does, and what the number is

Yardage shows an estimate of the distance, in yards, from your phone’s current GPS position to the mapped center of the green on the hole you selected. That is the whole product. It is an estimate, for these reasons:

  • Your position comes from your phone’s GPS receiver. GPS accuracy varies with sky view, trees, buildings, weather, the phone, its case, and its settings. The app shows a reduced-accuracy or stale status when it has one, and it needs Precise Location to be on. We make no guarantee about the accuracy of any position or any distance.
  • The center of the green comes from our course map. Maps can be wrong or out of date: greens are rebuilt, holes are renumbered, courses close. When you report a green that looks wrong, a person reviews the report before anything changes, and the change reaches you in a later version of the app.
  • The number is to the center of the green, never to the flagstick, the front edge, the back edge, a hazard or a lay-up spot. The app doesn’t show those, doesn’t suggest a club, and doesn’t adjust for elevation, wind or temperature.

Use the number as one input to your own judgment about a golf shot. It is not a substitute for looking at the hole, and it is not a navigation, safety or emergency tool of any kind. Don’t use it while driving a vehicle, including a golf cart in motion.

4. Playing safely and by the rules

You are responsible for playing safely and for following the rules of the course you’re on: its pace-of-play policy, its cart and phone rules, its dress code and its instructions to golfers. Look before you hit. Put the phone away when a shot is being played near you.

You are also responsible for knowing whether a distance-measuring device may be used in any competition you enter. Under the Rules of Golf a player may use a device to measure distance unless the Committee has adopted a Local Rule prohibiting it; the Committee’s Local Rules, hard card or conditions of competition decide. We make no representation that the app is permitted in any particular event, and we aren’t responsible for any penalty, disqualification or dispute that results from using it.

5. Courses, course data and corrections

The app ships with a catalog of mapped courses in the United States. A course appears only when we have a mapped green center for each of its holes; a course that isn’t in the catalog has no number, and the app says so. We add, change and remove courses in app updates at our discretion, and we don’t promise that any particular course will be, or will stay, in the catalog. Course information may be incomplete or contain errors; if something is wrong, tell us at support@theyardageapp.com.

Listing a course in the catalog, on this website or in the Golf Course Census means only that we have mapped it. It does not mean the course endorses Yardage, has any relationship with us, or has agreed to anything, and it says nothing about access, fees or whether the course is open to the public.

If you send us a correction (for example by using “Green looks wrong?” in the app) or a course request through a form on this site, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, adapt, publish and distribute the information you sent as part of the Service and its course data, and you confirm you have the right to give us that license. You don’t have to send corrections, and we don’t have to use them.

Course operators may display a “Mapped in Yardage” badge we provide, in the form we provide it, linking to the page we specify. We may withdraw that permission at any time by telling you, and you agree to remove the badge within a reasonable time if we do. The badge doesn’t make you our partner, agent or endorser, and you may not use our name or logo to suggest otherwise.

6. Purchases, subscriptions and refunds

Your first round in the App Store version is free. After that the app offers a single round (one round of up to eight hours, counted from when that round starts), a monthly subscription and an annual subscription. Current prices are shown in the app at the point of purchase and on the pricing page; prices can change, and a change never affects a period you have already paid for.

  • Every purchase is made through Apple’s App Store using your Apple Account. Apple processes the payment, holds your payment details, issues receipts and handles refunds under Apple’s terms and policies. We never see or store your payment information.
  • Subscriptions renew automatically at the end of each period, at the then-current price, until you cancel. Cancel at least 24 hours before the end of the current period to avoid being charged for the next one. You cancel in your iPhone’s settings under your Apple Account, then Subscriptions; deleting the app does not cancel a subscription. After cancelling you keep access until the period you paid for ends.
  • A single-round purchase waits on your phone until you start a round with it, and it is used only once that round shows its first distance; if the round can’t start, nothing is used. The round lasts until you end it, until the app ends it because you have left the course (more than 1,000 yards from all of its mapped greens and tees for at least 10 minutes), or until eight hours pass, whichever comes first. Refunds of any purchase, used or not, are handled by Apple under its policies.
  • Restore Purchases uses Apple’s standard mechanism to bring an existing monthly or annual subscription to a new or reinstalled phone. A single-round purchase is single-use and can’t be restored. Restore can’t create a purchase you didn’t make.
  • Refund requests go to Apple. If Apple asks us, we will tell them the truth about what happened.

During a TestFlight beta, testers get unlimited rounds at no charge for the duration of the beta. That is a courtesy, not a promise of future free use, and it ends when the beta build expires or the beta ends.

7. Beta software

A TestFlight build is pre-release software. It may contain features that are not in the public version, it may change or lose data, it may crash, and it may stop working when the build expires or when we end the beta. We can end your access to a beta at any time and for any reason. Anything you learn about unreleased features from a beta build, and any feedback you send us about it, may be used by us without restriction or payment to you; we don’t ask you to keep the beta confidential, but we don’t owe you anything for feedback either.

8. Acceptable use

Don’t do these things with the Service:

  • Break the law, or use the Service to help someone else break it.
  • Copy, scrape, extract, sell or redistribute the course catalog, the search index or the course pages, in bulk or by automated means, except for the Golf Course Census data we publish under an open license (section 9).
  • Reverse engineer, decompile or tamper with the app, or bypass its purchase, permission or access controls.
  • Send false reports or corrections, fake course requests, or spam through any form, or interfere with the forms’ spam and rate-limit protections.
  • Impersonate us, a course or another person, or suggest an affiliation with us that doesn’t exist.
  • Use the Service in any way that could harm it, our providers, other users or a golf course.

We may suspend or end your access to any part of the Service if we reasonably believe you have broken these terms. Apple controls access to the app itself.

9. Intellectual property and open data

The app, the website, the guides, the tools, the design, the Yardage name and the Y mark belong to Give Yourself Three LLC and are protected by copyright, trademark and other laws. Course information shown in the app and on this site is provided for reference only, and we do not claim ownership of third-party information. You get a limited, personal, non-transferable, revocable license to use the app on iPhones you own or control and to use the website as it is offered. You don’t get any other rights, and nothing here transfers ownership of anything to you.

One exception is deliberate: you may quote short excerpts of our guides with attribution and a link, as fair use ordinarily allows. Everything else stays reserved.

Third-party names, including the names of golf courses, rangefinder and watch brands, and Apple’s marks, belong to their owners and are used only to identify their products or places. Apple, App Store, TestFlight, iPhone, Dynamic Island and Live Activities are trademarks of Apple Inc.

10. The website

The guides, tools and data on this site are general information for recreational golfers. They aren’t professional, medical, legal or financial advice, and the tools’ results (a handicap estimate, a plays-like distance, a cost comparison, a pace estimate) are calculations from the numbers you enter, not facts about you or your course. Check anything that matters against the official source we cite. The site links to third-party sites we don’t control and aren’t responsible for. There are no sponsored or affiliate links on the site.

When you submit an email address or a course request through a form, you confirm the information is accurate and yours to give, and you agree to receive the emails that form describes. Every list email we send has an unsubscribe link. Our privacy policy says what we do with what you submit.

11. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy. Specifically, and without limiting that: we don’t warrant that any distance shown is accurate, that any course is mapped correctly or will remain in the catalog, that the app will work in any location, with any signal, on any phone or with any future version of iOS, or that the Service will be uninterrupted or error-free. Some jurisdictions don’t allow some of these exclusions, so some of them may not apply to you.

12. Limitation of liability

To the fullest extent the law allows, Give Yourself Three LLC, its owners, officers, employees, contractors and providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, wagers, prize money, competition standing or goodwill, arising out of or related to the Service, however caused and under any theory of liability, even if we were told such damages were possible. Our total liability for any claim arising out of or related to the Service will not exceed the greater of the amount you paid us through Apple for the Service in the twelve months before the claim arose, or fifty U.S. dollars. Nothing in these terms limits liability that can’t be limited by law, including for death or personal injury caused by negligence where the law says so, or your rights as a consumer that the law says can’t be waived.

You use a golf course, a cart and a golf club at your own risk. Nothing the app shows makes a shot safe, and we aren’t responsible for injuries, property damage or penalties that happen while you’re playing.

13. Indemnity

If a third party brings a claim against us because of something you did with the Service in breach of these terms or of the law, you agree to defend us against it and to pay any damages, costs and reasonable legal fees that result. We’ll tell you promptly about any such claim and let you handle the defense, as long as you don’t settle anything in a way that admits fault on our part without our written agreement.

14. Governing law and disputes

These terms are governed by the laws of the State of Florida and the federal laws of the United States, without regard to conflict-of-law rules. Any dispute that we can’t resolve informally will be brought in the state and federal courts located in Florida, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court where it qualifies, and except where the law where you live gives you the right to sue at home. Before filing anything, email us at support@theyardageapp.com and give us thirty days to try to sort it out; most things are a misunderstanding about a green.

15. Changes to the Service and to these terms

We can change, suspend or discontinue any part of the Service at any time, including removing courses or features and ending a beta. We can change these terms too. When we do, we’ll post the new version on this page with a new effective date, and for material changes we’ll say so in the app or on the site before they take effect. Using the Service after a change means you accept the changed terms; if you don’t, stop using the Service and, if you have a subscription, cancel it through Apple.

16. Everything else

  • These terms, the privacy policy and, for the app, Apple’s terms are the whole agreement between you and us about the Service.
  • If a court finds part of these terms unenforceable, the rest still applies.
  • If we don’t enforce a term right away, we haven’t given it up.
  • You can’t transfer these terms to anyone else. We may transfer them to a successor that takes over the Service, and we’ll tell you if that happens.
  • Notices to you may be given in the app, on the site or by email if you’ve given us one. Notices to us go to support@theyardageapp.com.

17. Contact

Give Yourself Three LLC runs the Service. Questions about these terms, and anything else, go to support@theyardageapp.com. A person reads it. For help using the app, start with the support page.
